Terms of Service

These terms govern use of the Trackfully platform ("the Service") provided by Trackfully ("we", "us"). By creating an account you agree to them on behalf of yourself and, where applicable, the organisation you represent.

The Service

Trackfully provides lead tracking, marketing attribution and reporting tools. We may improve or modify features over time; we won't materially reduce the core functionality you pay for during a paid term without notice.

Accounts and acceptable use

You're responsible for your account credentials, your team's use of the Service, and ensuring your use is lawful. You must not: attempt to access other tenants' data; probe, overload or disrupt the Service; use it to collect data unlawfully (including tracking without any legally required notice or consent on your own websites); or resell access outside your organisation and its clients.

Your data

You retain all rights to the data you and your websites submit ("Customer Data"). You grant us the licence needed to host and process it to provide the Service. We process personal data within Customer Data as your processor, as described in the Privacy Policy. You are responsible for having a lawful basis to collect the lead data you capture.

Billing

Paid plans bill in advance, monthly or annually, via Stripe. Plan limits apply as described on the pricing page. You can cancel at any time; service continues until the end of the paid period, after which the account becomes read-only — your data stays accessible, but tracking, lead updates and report sending pause until you reactivate. We may change prices with at least 30 days' notice, effective from your next renewal.

Availability and support

We aim for high availability but don't guarantee uninterrupted service. Planned maintenance and factors outside our control (including third-party providers) may cause interruptions. Support is provided by email at support@trackfully.co.uk.

Liability

Nothing in these terms limits liability that cannot be limited by law. Otherwise, our total liability arising in any 12-month period is capped at the fees you paid us during that period, and we're not liable for indirect or consequential losses, lost profits, or loss of data caused by factors outside our reasonable control. The Service is provided "as is" to the fullest extent permitted by law.

Suspension and termination

We may suspend or terminate accounts that breach these terms, create security risk, or have overdue payment (after reasonable notice for payment issues). You may delete your account at any time; on deletion, Customer Data is removed in line with the Privacy Policy.

General

These terms are governed by the laws of England and Wales, with the courts of England and Wales having exclusive jurisdiction. If any provision is unenforceable, the rest remain in effect. We may update these terms; material changes will be notified by email at least 14 days before they take effect.
